1. Agreement to Terms

By accessing or using our CLI, GitHub application, dashboard, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

2. Description of Service

PerfSentinel provides automated performance regression testing tools for React components. The Service is designed to run component profiling locally inside your secure CI/CD infrastructure, delivering structured performance regression metrics and pull request comments.

3. Account Registration and Security

To use certain features of the Service, you may be required to register for an account or authenticate using a third-party service (e.g. GitHub). You are responsible for maintaining the confidentiality of your credentials and tokens, and are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

4. Intellectual Property & Ownership

Your Code and Data: You retain 100% ownership and intellectual property rights in and to your application source code, components, tests, and configuration files. PerfSentinel claims no rights, titles, or ownership over the code you test using our CLI or GitHub application.

Our Service: The Service, including our CLI, custom testing scripts, website, UI/UX designs, and logo, is the proprietary intellectual property of PerfSentinel. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal testing operations.

5. Billing, Subscriptions, and Cancellation

Certain features of the Service are offered on a paid subscription basis ("Subscription Plan").

  • Fees: All fees are exclusive of taxes and are billed in advance on a recurring monthly or annual basis.
  • Cancellation: You may cancel your Subscription Plan at any time. Upon cancellation, you will retain access to the paid features until the end of your current billing cycle.
  • Refunds: Except where required by law, subscription fees are non-refundable.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, BUG-FREE, ACCURATE, OR THAT IT WILL DETECT 100% OF ALL PERFORMANCE REGRESSIONS. YOU ASSUME ALL RISK ASSOCIATED WITH INTEGRATING THE CLI OR THE GITHUB APPLICATION INTO YOUR BUILD ENVIRONMENT AND PIPELINES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PERFSENTINEL OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, CORRUPTION, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8. Termination

We reserve the right to suspend or terminate your account or access to the Service at our sole discretion, without notice, if you breach these Terms or engage in activities that threaten the stability, security, or integrity of our Service or other users' systems.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to conflict of law principles.
